Petitioner seeks bail in a case registered for the offences punishable under Sections 149, 341, 323, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act. For land dispute, the petitioner fired causing injury at the front of neck of Sanjay Paswan. Submission of the petitioner is that the petitioner is in custody since 02.07.2016 and the injured went for treatment by driving motorcycle which shows that the injuries were superficial. Moreover, the occurrence is there for land dispute. Considering the aforesaid facts and nature of allegation against the petitioner, I am not inclined to enlarge him on bail, in connection with Shahjahanpur Police Station Case No.

Patna High Court Cr.Misc. No.45765 of 2016 (3) dt.14-12-2016 2/2 26 of 2016 pending in the court of learned 5th Judicial Magistrate1st Class, Patna City, for the present. Hence, prayer is refused. The court below is directed to expedite the trial. However, the petitioner may renew his prayer for bail after six months.
