JUSTICE SHIVAJI PANDEY ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner and learned counsel for the State.
It is the fourth attempt of the petitioner for regular bail in connection with Masaurhi P.S. Case No. 42 of 2013 (Sessions Trial No.1474 of 2013), registered for the offence punishable under Sections 364/34 of the Indian Penal Code. Subsequently Sections 302 and 201 of the Indian Penal Code was added.
As it appears that out of nine witnesses six witnesses have already been examined and only three witnesses are yet to be examined by the Court below.
In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is
Patna High Court Cr.Misc. No.12627 of 2017 (3) dt.26-04-2017 2/2 rejected. However, the Trial Court is directed to conclude the trial as early as possible preferably within a period of six months from the date of receipt / production of a copy of this order. The Senior Superintendent of Police, Patna is directed to ensure the production of the rest witnesses.
