JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 366A/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by a bench of this court vide order dated 16.02.2016 passed in Cr. Misc. No. 54316 of 2015 but again petitioner is seeking bail on the ground that statement of victim was recorded in course of trial and in the said statement, she specifically stated that she had gone to Calcutta along with petitioner by her own violation and she further stated that she has solemnized her marriage with the petitioner.

Petitioner is in jail custody since 14.07.2015 and the

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Samastipur in connection with Sessions Trial No. 76 of 2016 arising out of Patori P.S.
