JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 147, 148, 149, 337, 338, 354, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act. Allegation against petitioners is of assaulting son of informant and others.
It has been submitted on behalf of petitioners that they have got no criminal antecedents. It is a case and counter case between the parties. Allegations of assault levelled against petitioners do not corroborate with the injury report. Petitioners have falsely been implicated in the present case due to political rivalry between the parties.
On behalf of the State and informant, it is submitted that petitioners have actively participated in course of occurrence. Considering the aforesaid facts and circumstances, I am

Any how if the petitioners surrender in the court below and pray for regular bail, same shall be considered and disposed of preferably on the same day without being prejudiced by this order. (Sudhir Singh, J) sudip/- U T
