JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Begusarai Town P.S. Case No. 78 of 2018 registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code. Prosecution case is that a dispute arose with respect to installation of hand pump in which accused persons, including the petitioner started assaulting the informant and later on they caught hold of son of the informant and assaulted by a liquor bottle on his head, due to which he became unconscious and he was taken to hospital.

Submission of learned counsel for the petitioner is that petitioner is own uncle of the injured and scuffle took place in respect of installation of hand pump and he has no intention to kill him.

Patna High Court CR. MISC. No.37021 of 2019(6) dt.20-09-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that though injury report disclosed that injury is simple in nature but it is also stated that the same is dangerous to life.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No. 78 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
