The petitioner seeks bail in Bikramganj P.S. Case No.201 of 2016 registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code. The informant lodged the case when her husband did not return. The informant alleged that her husband has hot altercation with his salesman Navratan due to missing of Rs.2,00,000/- from the cash box and Navratan was removed from the service of the shop.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The name of the petitioner has figured in the case in the confessional statement of co-accused

Patna High Court Cr.Misc. No.21333 of 2017 (3) dt.20-06-2017 Rupesh Kumar Singh. Save and except the confession of coaccused, there is no other material to show the involvement of the petitioner. The informant and other witnesses in paragraph 17 and 18 of the case diary disclosed that they came to know that the petitioner was also moving with other accused persons, but the informant and other witnesses have not disclosed the source of their knowledge and information. The petitioner is in custody since 12.11.2016.

The learned A.P.P. did not dispute these facts. Considering the facts aforesaid and the facts that save and except suspicion and confession of co-accused there is no other material to show the involvement of the petitioner in the alleged killing of the husband of the informant, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10, 000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj at Rohtas in connection with Bikramganj P.S. Case No.201 of 2016.
