JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 302/34 of the Indian Penal Code. As per prosecution, the mother-in-law of the deceased told the informant that in the morning there is confrontation took place between the deceased sister and her husband. The husband went to his duty and in the meantime sister of the informant set on fire and subsequently died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is the elder brother of the husband of the deceased. As per prosecution itself it is stated that the deceased committed suicide. There is no specific allegation against this petitioner. It is further submitted

Patna High Court Cr.Misc. No.29230 of 2015 (2) dt.28-07-2015 2/2 that no offence u/s 302 IPC is made out against the petitioner. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City in connection with Khajekalan P.S. Case No. 219/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
