Petitioner seeks bail in connection with Barsoi P.S. Case No. 162 of 2016 registered under Sections- 363, 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that in the medical report victim girl has been assessed to be of 19-20 years of age. The matter is of love affair. Victim and the petitioner solemnized marriage vide Annexure-2. In her statement under section 164 Cr.P.C. victim did not allege that petitioner misbehaved or made physical relation with her. Petitioner has no criminal antecedent and is in custody since 22.02.2017.

No.21483 of 2017 (3) dt.22-06-2017 2/2 Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Barsoi P.S. Case No. 162 of 2016.
