JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioners and the State. The petitioner seeks bail in Baisi P.S. Case No. 30 of 2017 instituted for the offence under Section-273 of the Indian Penal Code and 30(a) of the Bihar Excise (Amendment) Act, 2016.

It is alleged that total 34.140 litres foreign liquor have been recovered from near the seat on which the petitioner along with Mitu Kumar and Sonu Kumar was sitting. Seat Nos. has been mentioned in the written report as 34, 35 & 36. Learned counsel for the petitioner has submitted that co-accused Sonu has been granted privilege of bail by a coordinate bench of this court vide order dated 10-05-2017 passed in Cr. Misc. No. 21257 of 2017. This petitioner was arrested on the spot

In such circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Baisi P.S. Case No. 30 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Purnea subject to condition that both the bailors should be close relatives of the petitioner.
