JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-04-2022 Heard Mr. Subodh Kumar, learned counsel for the petitioner and Dr. Kumar Uday Pratap, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Special Case No. 4728/2020 arising out of Kankarbagh PS Case No. 570/2020 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act. 165 litres of country made illicit liquor along with 1.600 litre of foreign liquor was recovered from the hutment of the petitioner.

Learned counsel for the petitioner submits that the hutment of the petitioner is situated at an open space and at the time of search and seizure she was not present in the hutment

Patna High Court CR. MISC. No.52167 of 2021(2) dt.29-04-2022 2/2 and she did not know as to who kept the liquor in her hutment. Learned counsel further submits that petitioner is a lady and she is in custody since 05.06.2021. Charge-sheet has been submitted in the matter and there is no likelihood that she will abscond or tamper with the evidences.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is a lady and she is in custody since 05.06.2021, charge-sheet has been submitted in the matter and there is no likelihood that she will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, RUPA DEVI @ RUPAWA be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 4728/2020 arising out of Kankarbagh PS Case No. 570/2020.
