The Petitioner seeks bail in Birpur P.S. Case No. 74 of 2017 (Special Case No. 10/2017) instituted for the offence under Section 27(b)(ii) of the Narcotic Drugs and Psychotropic Substances Act as well as Sections 25(1-b) and 26 of the Arms Act.
It is alleged that corex syrup and other expired drugs and live cartridges were recovered from the premises and Ketan Kumar was found in that premises. It has been alleged in the written report that said Ketan Kumar disclosed that the premises belonged to the petitioner.
It has been submitted by the petitioner that he has
Patna High Court Cr.Misc. No.22827 of 2017 (2) dt.19-05-2017 2/2 given the premises on rent to Ketan Kumar and he has no concern with the seized articles.
From the written report, it appears that all the articles have been recovered from the premises where Ketan Kumar was found present. The petitioner was not present on the spot. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Supaul in connection with Birpur P.S. Case No. 74 of 2017 (Special Case No. 10/2017), subject to the conditions that both the bailors shall be the close relative of the petitioner.
