The petitioner seeks bail in connection with Mahua P.S. Case No. 320 of 2017 instituted for the offences under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The nephew of the informant was found to be lying dead by the side of the road. In that context, the informant has alleged that the deceased was married to one Soni Kumari. Later, with the efforts of the deceased, aforesaid Soni Kumari could become a graduate and was later employed with the railways. After getting appointed in the railway department, aforesaid Soni Kumari lost interest in her
Patna High Court Cr.Misc. No.25930 of 2018 (2) dt.18-05-2018 2/2 husband (deceased). As a result of this, the deceased had filed a case against his wife and her other family members. In this background, the informant has suspected that all the family members of aforesaid Soni Kumari might have killed the deceased.
The petitioner is own brother of aforesaid Soni Kumari. He is in custody since 01.01.2018. Apart from what has been stated in the F.I.R and that the deceased died a homicidal death, there is no other material to connect the petitioner with the crime.
Considering the aforestated facts, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Mahua P.S. Case No. 320 of 2017.
