JUSTICE SANJAY PRIYA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in connection with Phulpras P.S. Case No. 37 of 2011 instituted for the offence under Section(s) 302,34, 120(B) of the Indian Penal Code and 27 of the Arms Act.

It has been submitted on behalf of the petitioner that the petitioner is not named in the written report. The name of the petitioner has come during investigation in the statement of the witnesses. The learned Sessions Judge has mentioned that in para 43 of the case diary the witnesses have raised suspicion against the petitioner. In para 44 witnesses has clearly stated that accused Sanjay Yadav and Lochan Yadav had murdered the son of the

Patna High Court Cr.Misc. No.21677 of 2017 (2) dt.16-05-2017 2/2 informant. Lochan Yadav has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 39517 of 2011 vide order dated 25.01.2012.

In the facts and circumstances of the case, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge, II, Madhubani in connection with Phulpras P.S. Case No. 37 of 2011 subject to the conditions that both the bailors shall be the close relative of the petitioner.
