JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Sessions Trial No. 347 of 2017, arising out of Barharia P.S. Case No. 06 of 2017 instituted for the offences under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b) A, 26, 35 of the Arms Act.

On secret information that miscreants have congregated at a place for committing some offence, the thatched house of one Meera Manjhi was raided. Six persons are said to have been arrested from the house of Meera Manjhi. From the possession of the petitioner, one country made pistol and three live cartridges are said to have been recovered.

The learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.25989 of 2018 (3) dt.18-05-2018 2/2 that the implication of the petitioner in the present case is only on the basis of suspicion and the recovery of the arms and ammunitions has been shown from him at the instance of some of the persons who are inimical to him. In two earlier cases, which were lodged against the petitioner, he has been granted bail.

The petitioner is in custody since 10.01.2017. Regard being had to the period of custody of the petitioner, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned 4th Additional District & Sessions Judge, Siwan in connection with Sessions Trial No. 347 of 2017, arising out of Barharia P.S.
