The petitioner seeks bail in connection with Bounshi P.S. Case No. 196 of 2016, registered under Sections 25(1-b)(a), 26 of Indian Penal Code, pending in the Court of ACJM, Banka. The accusation is of recovery of one loaded country made pistol from the possession of the petitioner. Learned counsel appearing on behalf of the petitioner submits that petitioner is in custody since 17.10.2016. Learned counsel for the State vehemently opposed the prayer for bail of the petitioner and submits that petitioner has criminal antecedent.
