The petitioner, already in custody, seeks bail in connection with Chhatauni P.S.Case No. 26 of 2017 registered under Section 366A of the Indian penal Code.
Allegation in brief is that informant's daughter was kidnapped by the petitioner.
Submission is that it was a case of elopement, girl was major 26 years of age and she herself stated in the statement recorded under Section 164 Cr.P.C. that she was living with the petitioner in Lucknow and also alleges that petitioner's wife also assisted him in the kidnapping, which is improbable. Having considered the aforesaid facts and circumstances, the petitioner, namely, Arvind Kumar Yadav @ Guddu Jee is directed to be released on bail upon furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.25209 of 2018(4) dt.09-07-2018 2/2 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with Chhatauni P.S. Case No. 26 of 2017. (Arun Kumar, J) sujit/- U T
