JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is apprehending his arrest in connection with Tekari P.S. Case No. 138 of 2015 for the offences instituted under Sections 323/324/341/307/504/34 of the Indian Penal Code. Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that on the question of decorating the car in the marriage ceremony, differences cropped upon the point of payment of the charge for such decoration then it took an ugly scene when this petitioner became aggressive for non-fulfillment of such charges and started to assault the informant and others with scissors and other sort of weapons.

No.26983 of 2015 (2) dt.21-07-2015 2/2 It has been submitted on behalf of the petitioner that due to petty reason, the occurrence is said to have been taken place when the petitioner demanded for payment of decoration which has been made by him, but the same was not acceptable to the informant who started abusing the petitioner upon which he assaulted the victim. The injury report shows that the injury sustained on the body of the victim is simple in nature. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Tekari P.S. Case No. 138 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri S.Q.H. Rijvi, Judicial Magistrate 1st class, Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
