The petitioner seeks bail in Katoriya P.S. Case No. 98/2018, instituted for offences under Section(s) 376, 302 and 120B of the Indian Penal Code read with Section 4/6 of POCSO Act.

It is alleged in the written report that on 05.06.2018 informant got information that her three daughters have been murdered. Informant reached at her house and found her three daughters have been murdered. Informant raised suspicion against this petitioner and other accused persons, as named in the written report, in committing murder of her three daughters on account of old enmity.

Patna High Court CR. MISC. No.38506 of 2019(2) dt.27-06-2019 2/2 ordinate Bench of this Court vide orders dated 03.05.2019 passed in Cr. Misc. No. 11057/2019, dated 26.04.2019 passed in Cr. Misc. No. 8746/2019 and dated 24.04.2019 passed in Cr. Misc. No. 7309/2019. From the written report, it appears that the offence alleged is quite heinous and shocking as three girls were found murdered by unknown persons. But only suspicion has been raised against this petitioner and other co-accused in the written report. Learned counsel for the petitioner has submitted that there is no eye-witness of the occurrence. Investigation has been completed.

Petitioner is in custody since 19.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 1st, Banka, in connection with Katoriya P.S. Case No. 98/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
