2. Petitioner seeks regular bail in connection with Yogapatti (Jogapatti) P. S. Case No. 12 of 2025 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 .
3. As per the prosecution case, 90 liters of illicit liquor were recovered from the poultry farm of the petitioner.
4. Learned counsel for the petitioner submits that he is innocent and has committed no offense. He has been falsely implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and the poultry farm from which the alleged recovery has been made
Patna High Court CR. MISC. No.38450 of 2025(2) dt.08-08-2025 2/2 does not belong to the petitioner. He has been made accused in this case only on misleading information. Petitioner is in custody since 22.03.2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Court, Excise-II, Bettiah, West Champaran in connection with Yogapatti (Jogapatti) P.
