JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The petitioner and others are under suspicion, as per F.I.R., to have committed murder of Ajay Kumar Yadav son of the informant as Ajay Kumar Yadav had some relation with the daughter of co-accused Ram Bilas Sah.

Submission is that only material is suspicion and there is no other eyewitness of the occurrence. Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.21414 of 2017 (2) dt.03-05-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,Araria/Successor Court, in connection with Farbesganj (Simraha) P.S. Case No.701 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
