2. The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 75 of 2024 dated 10.04.2024, lodged under Sections 21(b) and 22 of the N.D.P.S. Act.

3. As per the prosecution case, the F.I.R. has been lodged against five named accused persons including the present petitioner and it has been alleged as per the seizure that recovery of 2 gm smack has been made from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that it is true that N.D.P.S. Act has been added. It is also true that the said recovery is less than the commercial quantity.

Patna High Court CR. MISC. No.43660 of 2024(2) dt.20-07-2024 2/2 He further submits that the petitioner is in custody since 10.04.2024 having clean antecedent. He further submits that the petitioner is aged about 19 years and under deep rooted conspiracy, he has been named in the F.I.R.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that it is a case of N.D.P.S. Act.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sessions-cum-Special Judge, N.D.P.S. Act, Araria in connection with Jogbani P.S. Case No. 75 of 2024, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

7. With this observation, the bail application stands allowed.
