The petitioner is apprehending his arrest in connection with Pipra P.S. Case No. 50 of 2021 for the offence registered under Sections 302, 201 and 120(B)/34 of the I.P.C. The prosecution story, in brief, is that the petitioner along with other accused persons conspired and killed the daughter of the informant.
It has been submitted by learned counsel for the petitioners the petitioner has falsely been implicated in the present case. The petitioner is co-villager of the deceased, daughter of the informant. He is separate in mess and property from the husband of the deceased and he has got no concern with the alleged occurrence. Petitioner has got no criminal antecedent. Patna High Court CR. MISC. No.50027 of 2021(4) dt.17-08-2022 2/2 Satahi Devi have already been granted pre arrest bail by a coordinate Bench of this court vide order dated 23.12.2021 passed in Cr. Misc. No. 46796/ 2021.
Learned counsel for the State opposes the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran, in connection with Pipra P.S. Case No. 50 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) BKS/- U T
