JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Singhiya P.S. Case No. 96 of 2014 for the offences instituted under Sections 366(A) and 380/34 of the IPC.

The prosecution story, in brief, is that one Ranjan Mukhiya gave a written petition before the concerned P.S. alleging therein that his brother and Bhoijai lived in Assam and he alongwith family members and daughter of the brother Chandrashekhar Mukhiya, namely, Puja Kumari, lived with him and on 24.06.2014 Munna Mukhiya with the help of Gita Devi kidnapped his niece alongwith Jewellery worth Rs. 25,000/- and cash Rs. 5,000/-.

Patna High Court Cr.Misc. No.28221 of 2015 (3) dt.29-09-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. The petitioner and the victim have married and they have given birth to a female child and the matter has been compromised between the parties.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Singhiya P.S. Case No. 96/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rosera, Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
