Mr. Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 406, 409 & 420/34 of the Indian Penal Code.

Petitioner, who happens to be Chairman of Vyapar Mandal, Lakhisarai, is said to have made defalcation of the huge amount of government coffer under Paddy Procurement Scheme 2015-16 and 2016-17 by showing the procurement of thousands of tones of paddy from the farmers by making forgery and conniving with other accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case due to dirty village

An Inquiry Committee, comprising the District Cooperative Officer, District Statistical Officer and District Supply Officer, after making enquiry in the matter, has found the allegation made against the petitioner false and baseless. Petitioner has not made any defalcation of the government money. Though one case has been lodged against the petitioner but he is on bail in the said case.

Learned APP for the State opposed the bail petition.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 440 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
