The petitioner seeks bail in connection with Paharpur P.S. Case No. 05 of 2017, registered under Sections 413 and 414/34 of the Indian Penal Code.
The accusation is that on receiving secret information about deal of stolen motorcycle at Pakariya Bazar. The Police reached there and three persons were seen with the motorcycle. Thereafter, they were apprehended, who disclosed their name Ranjan Kumar @ Chunnu Singh (Petitioner), Rishav Kumar @ Navneet Kumar and Chotu Pandey @ Sujeet Kumar. On search, one motorcycle was recovered from the possession of Rishav Kumar @ Navneet Kumar, whereas mobile phone was
Patna High Court Cr.Misc. No.20977 of 2017 (2) dt.18-05-2017 2/2 recovered from the possession of the petitioner. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner and petitioner is in custody since 09.01.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Sadar East Champaran at Motihari in connection with Paharpur P.S. Case No. 5 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
