2. The petitioner is apprehending arrest in connection with Madhubani Town P.S. Case No. 550 of 2024, dated 02.12.2024, lodged under Sections 109(1), 118(2), 126(2), 303(2), 308(5), 352, 351(3) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023").

As per the prosecution, an FIR has been lodged against four named accused persons, including the present petitioner, alleging that when the informant went to the pharmacy shop for some work, all the accused persons arrived and started abusing him. In the meantime, co-accused Raunik Parwana stabbed knife in the stomach of the informant, causing

Patna High Court CR. MISC. No.39022 of 2025(2) dt.25-06-2025 2/3 injury. It has further been alleged that the petitioner snatched Rs. 3,000/- from the informant's pocket and threatened him not to disclose anything regarding the occurrence.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that, as per the FIR, there is nothing specific against the present petitioner, and that the allegation of stabbing pertains solely to the co-accused Rounik Parwana. It is also submitted that the petitioner's criminal antecedent is not clean, as one criminal case is pending against him. Counsel further submits that the petitioner is ready to fulfill all the conditions that may be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is one criminal case pending against him.

6. As such, in the present facts and circumstances of this case, let the above-named petitioner be released on anticipatory bail in the event of arrest or surrender before the Trial Court within a period of four weeks from today, subject to the Trial Court being satisfied that the petitioner is not absconding in Madhubani Town P.S. Case No. 14 of 2022, upon furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand)
