In the present case, the petitioner prays for bail in connection with Sessions Trial No. 49 of 2016 arising out of Shahpur P.S. Case No. 37 of 2004 for offence under Sections 147, 148, 149, 302, 452 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner has earlier moved before this Court with a prayer for bail in Cr. Misc. No. 7477 of 2016 and this Court, vide order dated 12.04.2016, rejected the same. The allegation made against the petitioner is serious in nature.

Considering the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.

Patna High Court Cr.Misc. No.51514 of 2016 (6) dt.26-04-2017 Accordingly, the prayer for bail of the petitioner, namely, Lakshman Yadav is rejected.

The court below is directed to expedite the trial of the petitioner and conclude the same preferably within a period of nine months from today.

The Superintendent of Police, Bhojpur at Ara is directed to ensure production of all the witnesses so that the trial can be concluded without delay.

The court below is also directed to take all recourse for production of the witnesses and conclude the trial within the aforesaid time period.
