The petitioner seeks bail in anticipation of his arrest in connection with Barachatti P.S. Case No. 190 of 2020, dated 13.04.2020, instituted for the offences under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

72 kgs. of Doda is said to have been recovered from an open field, but concealed under mustard crops. The implication of the petitioner in the present case is on the basis of local Chawkidar informing the police that the place of recovery is the land of the petitioner.

Patna High Court CR. MISC. No.3704 of 2021(6) dt.17-12-2021 2/2 It has been submitted on behalf of the petitioner that the recovery is from an open place and he does not have land in the locality where the recovery has been made. Apart from this, it was submitted that he is 80 years of age.

Since no document was brought on record in support of the proof of the age of the petitioner, his counsel took time for filing supplementary affidavit bringing on record any document to demonstrate his age.

The learned counsel for the petitioner submits that inadvertently and loosely his pairvikar disclosed his age to be 80 years. From the AADHAR card, the petitioner is around 73 years of age.

Regard being had to the circumstances of the case, the provisional bail granted to the petitioner is, hereby, confirmed. He shall remain on the same bail-bonds. The application stands disposed off accordingly. (Ashutosh Kumar, J) Praveen-II/- U T
