Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Sessions Trial No. 294 of 2021 arising out of Balia (Ballia) P.S. Case No. 349 of 2018 instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code.
This is the third attempt of the petitioner to seek bail as earlier his bail was rejected by order dated 20.11.2019 in Cr. Misc. No. 48848 of 2019 and thereafter by order dated 02.12.2020 in Cr. Misc. No. 21094 of 2020.
Learned counsel for the petitioner submits that by order dated 02.12.2020, this Court had directed to conclude the trial within a period of six months from the date of framing of
Patna High Court CR. MISC. No.50595 of 2021(3) dt.24-02-2022 2/2 charge.
Learned counsel for the petitioner submits that the charges against the petitioner were framed on 13.08.2021 and till date only one witness, namely, Babita Devi has been examined and, that too partly, there are altogether six witnesses in this case. Learned counsel further submits that the petitioner is in custody since 21.04.2019 i.e. nearly three years. Considering the period of custody of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Begusarai in connection with Sessions Trial No. 294 of 2021 arising out of Balia (Ballia) P.S. Case No. 349 of 2018, with condition that if the petitioner does not appear in the trial on two consecutive dates, the learned court below will immediately cancel the bail bond of the petitioner.
