JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-07-2015 Heard learned counsel for the petitioners, learned counsel for the informant as well as learned APP. The petitioners apprehend their arrest in registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that the petitioners came on his Darwaja and Bhola Mukhiya assaulted the informant with iron rod. The wife of the informant was also assaulted with iron rod. The informant and his wife become unconscious. It is submitted that there is counter version being Patahi P.S. Case No. 34 of 2015. On account of construction the occurrence took place. Bhola Mukhiya and his daughter got one
Patna High Court Cr.Misc. No.28695 of 2015 (2) dt.28-07-2015 2/2 abrasion on skull and pain and tenderness. The daughter of Bhola Mukhiya got two tenderness on back two trunk and neck. The injuries are opined to be simple in nature. From the side of the petitioners also many persons are injured.
Considering the facts aforesaid and the fact that on account of land dispute the occurrence took place and both the sides got injuries, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sikrahana at Motihari in Patahi P.S. Case No. 33 of 2015.
