The petitioner seeks bail in connection with Fulkaha P.S. Case No. 38 of 2017 for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code. The allegation against the petitioner is kidnapping the victim girl.

The learned counsel for the petitioner submits that there is no allegation of any sexual assault, hence the petitioner should be enlarged on bail. The petitioner is said to be languishing in custody since 05.05.2017.

I have perused the records, the statement of the victim girl made under Section 164 Cr.P.C. as well as the case diary and I find that there is ample material to proceed against the petitioner.
