By filing this writ petition petitioner, who is a retired employee of the Food Corporation of India, has informed this Court that in spite of the direction of his employer contained in letter dated 18.03.2009, Annexure-5 to the Branch Manager, State Bank of India, Main Branch, Patna to release a sum of Rs. 1,12,428/-, wrongly deducted towards DCRG and value of commutation is not being released. In this connection, Bank authorities have filed counter affidavit, in Paragraph 8 whereof, it is stated that the aforesaid amount was released in favour of the petitioner in two transactions of Rs. 49,542/- towards DCRG and Rs.

Patna High Court CWJC No.2560 of 2011 dt.27-03-2015 2/2 62,886/- towards commutation of pension.

3. In view of the stand taken in the counter affidavit, I direct the Branch Manager, State Bank of India, Main Branch, Patna to communicate the aforesaid stand, as incorporated in this order, to the petitioner as also to his employer Deputy General Manager, who under letter dated 18.03.2009, Annexure-5 directed the Branch Manager, State Bank of India, Main Branch, Patna to release the amount within one month from the date of receipt/ production of a copy of this order so as to enable the petitioner to assail the same in accordance with law.
