This is a petition for grant of regular bail in a case registered for offences punishable under Sections 147, 341, 323, 308, 385, 337, 379 and 504 of the Indian Penal Code. The allegation upon the petitioner is of demanding a sum of Rs. 25,000/- from the informant. Upon refusal, the petitioner started bricks batting, which caused injuries on the head and hand of the son of the informant and he fled away with the house hold articles.
Submission is that there is a case and counter case also and the injury sustained by both parties are simple in nature. All
Patna High Court Cr.Misc. No.53981 of 2016 (3) dt.16-02-2017 2/2 Sections except Sections 308 and 379 of the Indian Penal Code are bailable. The allegation against the petitioner is general and omnibus and there is a series of cases, pending between the parties since long and the petitioner is in custody since 19.10.2016. However, learned A.P.P. for the State opposed the prayer for bail.
Considering the facts and circumstances, let the above named petitioner, Arjun Prasad Keshari @ Arjun Keshri Devi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Delha P.S. Case No. 184 of 2016. (Arvind Srivastava, J) Sudha/- U T
