JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Rampur P.S. Case No. 300 of 2014, registered under Sections 364, 302, 201 and 120-B of the Indian Penal Code.

The accusation is that on 03.10.2014 at about 4.00 P.M. Sudhir Kumar, son of the informant, who is driver, left the house, but he did not returned to his house. Earlier, on 02.10.2014, Sudhir Kumar received several calls on his mobile through mobile No. 9801957349.

Learned counsel for the petitioner submits that in course of investigation, the confessional statement of Golu Choudhary, Shankar Manjhi and Raj Kumar Manjhi were recorded by the Police as detailed in para-26 of the case diary in

Patna High Court Cr.Misc. No.21004 of 2017 (3) dt.21-06-2017 2/2 which it is said that dead body of Sudhir recovered from the forest on 19.10.2014. Shankar Manjhi confessed his guilt and disclosed the name of petitioner and also disclosed that Barahan Prasad hired them for killing of Sudhir Kumar after payment of Rs. 50,000/-, except the confessional statement of co-accused as detailed in para-26 of the case diary, nothing has come against the petitioner to show his involvement in the present case. Further submission is that petitioner is a lady and she is in custody since 03.06.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-IV, Gaya in connection with Rampur P.S. Case No.300 of 2014. (Rajendra Kumar Mishra, J) manish/- U T
