2. The petitioner has preferred this application for grant of regular bail in connection with Trial No. 1030 of 2024 arising out of Yadopur P.S. Case No. 8 of 2012 dated 06.02.2012, registered for the offence/s punishable under Section 302/34 of the Indian Penal Code.

The allegation is that the FIR named accused persons including the petitioner are alleged to have caught hold of the husband of the informant while Hirdeyaram inflicted blows of knife on the chest and rib portion (Pajra) of the body, resulting into bleeding and owing to that injury informant's husband died.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.42593 of 2024(3) dt.07-08-2024 2/2 petitioner is innocent and has falsely been implicated in this case. As the petitioner is brother of main accused, Hridayaram, he has been implicated in this case. The specific allegation of inflicting blows of knife is against the co-accused Hridayaram. Petitioner is aged about 60 years old and will cooperate in the trial. Charge sheet has been submitted. The petitioner is in custody since 02.02.2024 who has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the clean antecedent of the petitioner, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Gopalganj in connection with Trial No. 1030 of 2024 arising out of Yadopur P.S. Case No. 8 of 2012.

7. The application stands allowed.
