Petitioners are in custody since 17.03.2017 in connection with G.O. Case No. 55 of 2017 registered under Sections 30(A) of the Bihar Excise Amendment Act, 2016.

Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioners and the petitioners have no concern with the alleged recovery. The petitioners are rotting in custody for the last two months.

Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.21601 of 2017 (2) dt.17-05-2017 the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of the learned I/C, S.D.J.M., Pupari, Sitamarhi in connection with G.O. Case No. 55 of 2017.
