The petitioner seeks bail in Special Case No. 80 of 2016, arising out of Salimpur P.S. Case No. 138 of 2016 registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act.
The police got information that somebody is carrying Ganja on a boat. On such the police went to raid but the accused persons started fleeing away after seeing the police. On chase Bhulu Rai, Rabindra Rai and Panchhi Rai the petitioner, were apprehended. Bantha Rai managed to flee away. 32 kgs. of Ganja was recovered from the boat of Bhulu Rai.
Learned counsel for the petitioner submits that the petitioner has no manner of concern with the Ganja kept in the
Patna High Court Cr.Misc. No.21057 of 2017 (3) dt.21-06-2017 2/2 boat. From perusal of the seizure list, it appears that the Ganja was recovered from the boat of Bhulu Rai. It is further submitted that four persons are said to have been carrying Ganja and for that the petitioner is in jail since 21.10.2016. The petitioner has already remained in jail for more than eight months.
Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge3rd Patna in Special Case No. 80 of 2016, arising out of Salimpur P.S. Case No. 138 of 2016.
