2. Petitioner seeks regular bail in connection with Asthawan P.S. Case No.01 of 2025 registered under Sections 126, 115(2), 352, 109, 117(2), 190, 191(2) of B.N.S.

3. As per prosecution case, the petitioner and other accused persons abused and started assaulting the informant, her husband and her son with iron rod and sword due to which they sustained injuries.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The present case is a counter blast of a case lodged by the petitioner's side. There is no specific allegation against the petitioner rather the allegations are general and omnibus in

Patna High Court CR. MISC. No.38475 of 2025(3) dt.13-08-2025 2/2 nature. The informant sustained injuries on her hand and leg but the same is on non-vital part of the body. It is further submitted that similarly situated co-accused Bindeshwari Chaudhari has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 07.05.2025 in Cr.Misc.No.26499 of 2025. The charge sheet has already been submitted and there is no chance of tampering with the evidence or absconding of petitioner. Petitioner has no criminal antecedent and he is in jail since 20.04.2025. Petitioner undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Bihar Sharif, Nalanda in connection with Asthawan P.S. Case No.01 of 2025.
