====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-08-2021 Heard Mr. Hriday Narayan Harshit, the learned Advocate for the petitioner and Mr. Kalyan Shankar, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Lakhnour (R.S. O.P.) P. S. Case No.169 of 2020, instituted for the offences under Sections 341, 323, 308, 325, 354(B), 379, 504, 506, 34 of the Indian Penal Code. The accusation against the petitioner is of having assaulted the informant by means of garasa on the backside of his head. Thereafter the informant was assaulted by Anil Kumar Mahto.

The learned Advocate for the petitioner has submitted that there is a counter-version of the occurrence also lodged by the petitioner vide Lakhnour (R.S. O.P.) P. S. Case No.168 of

Patna High Court CR. MISC. No.3634 of 2021(2) dt.26-08-2021 2/2 2020. The petitioner has received grievous injury in the transaction. The injuries suffered by the informant of the subject F.I.R. is stated to be simple in nature. There is a land dispute between the parties and they are agnates as well. For the reasons afore-stated, the petitioner, abovenamed, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Jhanjharpur, Madhubani in connection with Lakhnour (R.S. O.P.) P. S. Case No.169 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
