Petitioners seek regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
As per the prosecution case, two unknown miscreants riding on a motor cycle stopped the informant and snatched the bag containing cash, cheque book, ATM card and other valuable documents and fled away.
Learned counsel appearing for the petitioners submits that petitioners are not named in the FIR. The names of petitioners have come in this case during the course of
Patna High Court CR. MISC. No.49519 of 2021(3) dt.10-12-2021 2/2 investigation in the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioners and till date the petitioners have not been put on Test Identification Parade. Petitioners are in custody since 06.01.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that these petitioners were identified by the informant during the course of investigation. Considering the facts and circumstances of the case, nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected for the present.
