The petitioner apprehends his arrest in Barauni P.S. Case No. 383 of 2010 instituted under Sections 328, 304B/34 of the Indian Penal Code.

The petitioner is the brother-in-law of the deceased and there is omnibus and general allegation that all the accused persons administered poison to the deceased. The viscera report also shows that the deceased died on account of consuming sulphas.

It is submitted that father-in-law and mother-in-law have already been granted anticipatory bail vide order passed in Cr. Misc. No. 49144 of 2013 and the case of the petitioner stands on the same footing.

Patna High Court Cr.Misc. No.1927 of 2015 (2) dt.16-01-2015 Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar, the learned Ist Class Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 383 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
