The petitioner is languishing in custody for the offences punishable under Sections 399/402/413/414/467/468/ 471/420 of the Indian Penal Code.
Three persons apprehended by the police at the spot disclosed the name of others who allegedly fled away from there and name of the petitioner figures in that disclosure. Submission is that the petitioner is in custody since 01.02.2018. Petitioner has got no criminal antecedent. Two motorcycles were allegedly recovered from the outer verandah of the petitioner. One was of the uncle of the petitioner and another was of the cousin of the petitioner. Paper of the vehicle standing
Patna High Court Cr.Misc. No.26089 of 2018 (3) dt.15-05-2018 P2/ in the name of the uncle of the petitioner has been produced. However, no paper has been produced in respect of another vehicle. Investigation of the case is already complete. Considering the entire fact and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bhairab Asthan P.S. Case No.6 of 2018, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
