JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Complaint Case No.666(C) 2012 for the offence instituted under Section 498(A)/34 of the I.P.C. and 3⁄4 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in short, is that the complainant was married with the petitioner Vijay Sharma on 24.6.2002 according to Hindu Rituals in course of which father of the complainant had gifted some article. After some times of marriage accused persons started demanding motor cycle and on

It has been submitted on behalf of the petitioner that the petitioner is ready to keep the complainant but the same is not acceptable to her. The petitioner is ready to deposit a sum of Rs.1000/- per month before the court below which shall be released in favour of the complainant.

On behalf of the State it is submitted that the petitioner is named in the complaint who is husband of the complainant.

Considering the aforesaid fact, it is directed that the petitioner shall deposit R.1000/- per month in the court below which shall be released in favour of the complainant and on doing so the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Bhojpur at Ara, in Complaint Case No.666(C) of 2012 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
