The petitioner seeks bail in connection with Khajekala P.S. Case No. 226 of 2016 registered for the offences punishable under Sections 341, 323, 325, 337, 338, 307/34 of the Indian Penal Code.

Allegedly, the petitioner along with other co-accused persons assaulted the informant with fist and slap by which informant sustained injuries on head and face and become unconscious and then he was taken to N.M.C.H. for his treatment. Submission is of false implication. Due to previous enmity between the parties, altercation took place. There is general and omnibus allegation against the petitioner. Petitioner is

Patna High Court Cr.Misc. No.22370 of 2017 (3) dt.29-05-2017 2/2 suffering in custody since 20.01.2017. Injuries sustained by the informant are simple in nature and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Patna City, Patna in connection with Khajekala P.S. Case No. 226 of 2016 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
