17-06-2015 Heard Sri Dinesh Prasad Verma, learned counsel for the petitioners and Sri Chandrasen Prasad Singh, learned Addl. Public Prosecutor.
Three petitioners, apprehending their arrest in connection with Singeshwar P.S. Case No.193 of 2014 registered for the offence under Sections 147,148, 341, 323, 324, 307, 354, 379, 504, 506 of the Indian Penal Code and Sections 3/14 of the Witchcraft Act, have prayed for grant of anticipatory bail. Learned counsel for the petitioners submits that of course, petitioners were named in the F.I.R. along with number of accused persons, no specific accusation has been levelled against
Patna High Court Cr.Misc. No.20097 of 2015 (2) dt.17-06-2015 2/2 the petitioners. He submits that in this case, counter case i.e. Singeshwar P.S. Case no.194 of 2014 has also been filed vide Annexure-3 to the petition, in which date and time of occurrence has also been given as same.
Learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail.
In view of the fact that there was case and counter case as well as fact that there is no specific allegation against the petitioners , let the aforesaid three petitioners, namely, (i) Jairam Yadav (ii) Bijendra Yadav and (iii) Surendra Yadav, in the event of their arrest or surrender within a period of one month from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singeshwar P.S. Case no.193 of 2014 subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
