ANJANA MISHRA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of O.P.No.2.

The petitioner is apprehending his arrest in connection with Kankarbagh P.S. Case No. 627 of 2014 registered for the offences punishable under Sections 498(A)/34 of India Penal Code and 3⁄4 of Dowry Prohibition Act.

The matter came before this court, in which, steps have been taken regarding reconciliation. When the matter could not be resolved in this Court, it was sent to the mediation centre so that some sort of settlement could be arrived at. However, the mediator has now, reported that mediation could not succeed and the petitioner and O.P.No.2 are still at loggerheads.

Patna High Court Cr.Misc. No.28992 of 2015 (9) dt.02-05-2016 2/2 Considering the entire facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Kshiprachala Anjlee, Judicial Magistrate, Patna in connection with Kankarbagh P.S. Case No. 627 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. However, it is made clear that the petitioner shall ensure that one of the bailors will be his father.

Further it is also directed that the petitioner will make himself available before the Court below, as and when required. It is further made clear that if, the petitioner makes himself absent or there is no proper representation on his behalf in the Court below for two consecutive dates, it would be open to the O.P.No.2 to move this Court for cancellation/modification of his bail.
