The petitioner seeks bail in Bhagwanpur P.S. Case No.235 of 2016 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. The mother of the victim alleged that on 28.11.2016 at about 6.00 in the evening the petitioner enticed away her minor daughter for the purposes of marriage or to sell her. Learned counsel for the petitioner submits that the victim caught inside the premise of the civil court and she made her statement under Section 164 Cr.P.C. She disclosed that she was kidnapped by the petitioner, his father and uncle in the mid of night and they took her to Delhi after making her unconscious. It is submitted that the victim made a different story about her

Patna High Court Cr.Misc. No.21345 of 2017 (3) dt.20-06-2017 kidnapping. The victim did not allege any assault at the hands of the petitioner. The father and uncle of the petitioner have already been enlarged on bail. The petitioner is in custody since 01.12.2016. The petitioner has already remained in jail for seven months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10, 000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No.235 of 2016.
