JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.

Petitioner apprehends his arrest in connection with Complaint Case No. 474 of 2013 in which cognizance has been taken for the offence punishable under sections 406 and 420 of the Indian Penal Code.

Without admitting the case of the complainant petitioner is ready to return Rs.1,25,000/- to the complainant in three equal installments.

Taking note of the aforesaid proposal as well as facts and circumstances of the case this petition is allowed and it is ordered that petitioner, in the event of his arrest or surrender within four weeks from the date of receipt / production of copy of

No.282 of 2015 (2) dt.07-01-2015 2/2 this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Complaint Case No. 474 of 2013, subject to the condition as laid down under section 438(2) of the Cr.P.C with further condition that petitioner shall deposit Rs. 1,25,000/ before the court below in three equal installments within three months from the date of his release. Failure on the part of the petitioner shall give liberty to the court below to cancel the bail bonds of the petitioner. It is also made clear that the complainant may withdraw the aforesaid amount from the concerned court subject to final result of Complaint Case no. 474 of 2013.
