JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-08-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner wants to renew his prayer for pre-arrest bail which had already been rejected by order dated 08.01.2015 passed in Cr. Misc. No. 15548 of 2014 on the ground that earlier some facts were not placed and brought on the record and by way of supplementary affidavit the same has been brought on record. The security of the paddy was given to the Police Incharge, Wajirganj Police Station, Block Development Officer and the Circle Officer, Wajirganj and this fact is evident from the letter issued by the Subdivisional Officer, Sadar, Gaya vide memo no. 326 dated 22/25.02.2013. Further there is contradiction in the letters which makes the F.I.R. doubtful.

Patna High Court Cr.Misc. No.29093 of 2015 (6) dt.19-08-2015 2/2 The learned counsel for the Bihar State Food Corporation opposes the prayer for pre-arrest bail of the petitioner by submitting that if the petitioner will deposit the defalcated amount then the matter can be reconsidered.

Considering the submissions and finding no good ground for reconsideration of prayer for pre-arrest bail of the petitioner, again prayer for pre-arrest bail of the petitioner stands rejected in connection with Wajirganj P.S. Case No. 71 of 2014 pending in the court of C.J.M. Gaya.
