JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 24.11.2014 on the ground that one detonator was recovered from his conscious possession but submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and, earlier, his prayer for bail was rejected on infancy stage of this case. The trial court has reported that charge against the petitioner and others was framed on 19.09.2016 and the summons have already been issued to witnesses.

Considering the period of detention of the petitioner in jail custody as well as considering this aspect of

Patna High Court Cr.Misc. No.51421 of 2016 (3) dt.15-02-2017 2/2 the matter that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Learned Sessions Judge cum Special Judge, Muzaffarpur in connection with Deoriya P.S.Case No.110 of 2014.
